These Terms and Conditions of Sale (hereinafter, the "Terms and Conditions of Sale") regulate the agreement between the company Itsasne Miren Beotegui Del Olmo, hereinafter Mucho Power, with address at Calle del Teatro, número 30, 5º derecha, 03001, Alicante, Spain and the customer (hereinafter, the "Customer") formalised through the website www.muchopower.es (hereinafter, the "Website") for the purchase of Mucho Power products by the Customer via the Website. 2. Purchasing procedure
2.1. Conditions for purchase
In order to place an order via the Website, the Customer must be over 18 years of age. Minors are expressly excluded. In order to place an order on the MUCHO POWER website, the Customer must provide the necessary personal information for delivery of the order. The Customer’s details are protected in compliance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce, as stated in the Privacy Policy.
2.2. How to place an order
In order to place an order via the MUCHO POWER Website, you must follow these steps:
- Choose the desired products and add them to "My basket" using the “Add to basket” button.
- Complete the purchase by clicking on the basket and pressing "Proceed to checkout" once the order is complete.
- At this point, the Customer must select the relevant payment option and proceed with the purchase.
- Once payment has been confirmed, the order is processed and prepared for shipping.
Mucho Power may change the Terms and Conditions of Sale at any time and without prior notice to the Customer. However, Mucho Power will announce any changes if an order is cancelled due to lack of availability and Mucho Power will refund (if applicable) the value of the order. The shipping costs are never refunded, except in the circumstances described in the Returns section. Once the Customer has received confirmation of their purchase from Mucho Power, the applicable Terms and Conditions of Sale cannot be modified.
2.3. Availability of products
Orders placed via the website are subject to availability of the product. Mucho Power tries to guarantee that all the items it sells are in stock. If the requested product is not available or is out of stock, the Customer will be notified by email and the amount paid will be refunded within 30 days after payment is made.
2.4. Mucho Power’s right to cancel or not accept an order.
Mucho Power may reject any order, cancel it or not accept a confirmed order for the following reasons. We will notify you by email before any action is taken in order to try to solve the problem and return any payment made:
- a) There was a technical or pricing error on the Website when the order was placed.
- b) The product that appears in the order is not available.
- c) The payment information provided was incorrect or cannot be verified.
- d) The security systems indicate that there is a problem with the order or it may be fraudulent.
- e) There is reason to believe the Customer is a minor (under 18 years of age).
- f) After 3 attempts, Mucho Power has been unable to deliver the order to the address provided.
If an order is cancelled due to any of the above reasons, Mucho Power will refund the value of the order and the shipping costs paid, except in the case of failed deliveries described in point "f".
- g) The delivery is outside mainland Spain, Balearic Islands or Portugal, as Mucho Power cannot deliver to the Canary Islands, Ceuta, Melilla or countries other than those listed on the Website.
- h) If the Customer changes the delivery address stated on the form once payment has been made. In this case, the Customer will also be responsible for paying the shipping costs.
2.5. Data verification
Before processing a Customer’s order, Mucho Power may check their data: their address, the customer’s solvency and whether there may be any fraud involved. With regard to possible cases of fraud, Mucho Power may use a partially automated check of all purchases to filter those that are considered anomalous or suspicious of fraud. If any orders are suspected of fraud, they may be reported to the pertinent authorities, which may take legal action against them.
3. Price and payment
3.1. Prices and currency
The prices and offers presented on the Website include VAT (value added tax) and are only valid for orders placed online via the Website in Spanish territory.
3.2. Method of payment
To pay for the order the Customer may either use a credit or debit card in their own name or pay via Google Pay or Apple Pay. The payment will be charged after the order is confirmed.
3.3. Changes in price
The prices that appear on the Website may be modified at any time; however, any changes made will not affect orders for which we have already sent Confirmation of purchase. Mucho Power informs you that despite carefully updating the prices on the Website, they may contain errors. Any errors that appear in the prices will be corrected as swiftly as possible and will not be binding for Mucho Power. If an error is discovered in the price of one of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we do not manage to contact you, the order will be considered cancelled and the amount paid will be refunded in full.
3.4. Value added tax
For the purposes of applying the appropriate VAT in accordance with the regulations on online sales, it will be considered that deliveries are made in the Member State that appears in the delivery address. Therefore, all purchases made via the Website will be subject to VAT.
4. Delivery
4.1. Where and when
Deliveries are made from Monday to Friday. No deliveries will be made at weekends or on local public holidays. Orders may only be delivered to private residences or offices. Deliveries will be made during business hours. To facilitate delivery, Customers are therefore advised to use their home or work address, or provide another address where there is someone available to receive the goods.
4.2. Delivery times
Deliveries to Spain
Orders are normally delivered within 24-48 hours after making the purchase, provided the order is placed before 5 pm, not counting Saturdays, Sundays and public holidays. Orders are normally delivered within this time and, although Mucho Power cannot guarantee punctuality, all orders are delivered within a maximum of 30 days of confirmation of receiving the order.
Delivery to Europe
4.3. Verification on receipt
The Customer must check the condition of the goods on receipt. If the packaging is damaged, the Customer should not accept the delivery. Mucho Power informs you that the delivered goods must be checked within a reasonable period of time after their receipt. If notification of rejection of the goods has not been received 30 days after their delivery, Mucho Power will consider that the Customer has accepted them. This does not affect the rights granted to customers by the current legislation regarding guarantees.
5. Shipping costs
Delivery to mainland Spain, Balearic Islands and Portugal
Shipping costs apply to each separate order. Under no circumstances will orders be delivered to areas outside mainland Spain, Balearic Islands and Portugal. If, for any reason, the Customer places an order with a delivery address outside mainland Spain and the Balearic Islands, the order will not be processed and the Customer will be responsible for paying any costs incurred by Mucho Power as a result of this. Shipping costs:
1) Standard delivery to mainland Spain and Portugal (24/48h) – €6. Free delivery over €100
2) Standard delivery to the Balearic Islands (24/48h) – €8. Free delivery over €120

6. Returns policy
6.1. LEGAL RIGHT TO CANCEL.
As a consumer, you are legally entitled to withdraw from this contract without having to give any reason within the 14 calendar days after you or a third party authorised by you have received the product at the delivery address specified in your order. To exercise this right you will need to expressly notify us of your decision by sending this returns form (use of which is not obligatory) via the following channels:

6.2 CONSEQUENCES OF CANCELLATION
If the Customer wishes to cancel and return the order, we will refund all payments received upon purchase, not including the shipping costs, without any undue delay and within no more than 14 calendar days after we are informed of the decision to cancel this contract. The refund will be made by means of the same method of payment used for the initial transaction, unless the Customer has expressly stated otherwise. In any case, they will not incur any expenses as a result of the refund. MUCHO POWER may withhold the refund until the goods have been received or until the Customer has provided proof of the return. The Customer must return or deliver the goods to us directly without any undue delay within no more than 14 calendar days from the date on which they notify us of their decision to cancel the contract. This condition will be considered to be fulfilled if the goods are returned within this time frame. In order to return the goods, the Customer may use the courier services that MUCHO POWER provides and the shipping costs, in this case, are paid the Customer or purchaser exercising their right to cancel.
6.3 RETURN OF FAULTY GOODS.
If, upon receipt, the Customer considers that the product does not comply with the terms of the contract, they should contact MUCHO POWER immediately using any of our means of contact, giving details of the product and the damage it has suffered. If the product is found to have some defect once MUCHO POWER has made the necessary checks, MUCHO POWER will have the product collected at no cost to the Customer and will refund the price that the Customer has paid for the product, as well as any shipping costs, within a maximum of 14 days of MUCHO POWER receiving the returned product.
7. Product exchanges
Products cannot be exchanged. To acquire a product in a different colour or size, the customer must return the original item and place another order via the MUCHO POWER Website.
8. Validity of offers ("PROMOTIONAL OFFERS")
Any promotional offers that are shown on the Website to increase sales of certain products are only valid while they appear on the Website, unless stated otherwise.
9. Liability
These Terms and Conditions of Sale establish all MUCHO POWER’s obligations and responsibilities with respect to the supply of products. There are no guarantees, conditions or other terms that are binding for MUCHO POWER, except those expressly mentioned in the Terms and Conditions of Sale. Nothing in these Terms and Conditions of Sale limits or excludes MUCHO POWER’s liability for (I) death or personal harm caused by negligence on the part of MUCHO POWER, (II) fraud, (III) any breach of the obligations arising from the applicable national laws, or (IV) any liability that cannot be excluded by law.
10. Applicable legislation
Purchases made through the MUCHO POWER Website and under these Terms and Conditions of Sale are subject to Spanish legislation.
11. Competent jurisdiction
Any dispute or discrepancy arising from the application or interpretation of the Terms and Conditions of Sale and the contracts contained herein will be resolved in the corresponding territorial jurisdiction by virtue of the applicable legislation in Spain. However, if the Customer holds the status of consumer according to the Spanish law for the defence of consumers and users, the competent courts will be those of the Customer’s place of residence in Spain.
